WEBSITE DONATIONS TERMS OF SERVICE
1 INTRODUCTION
1.1 The CAF website allows you to make a
donation to a charity of your choice. Donations can be made
by debit card, credit card and PayPal by following the instructions
on the website.
1.2 These terms of service describe how you
can make donations to your chosen charity using the website and
what CAF can do and will do for you, and what CAF asks of you in
return. By using the website to make a donation you indicate
your agreement to these terms of service. If you do not wish
to be bound by these terms of service, you should not use the
website to make a donation.
1.3 CAF may amend or update these terms of
service from time to time. It is your responsibility to check
these terms of service whenever you make a donation using the
website. The most recent version of these terms of service
from time to time will govern your use of the website in the
future.
2 ABOUT CAF AND THE CHARITIES YOU MAY DONATE TO
2.1 CAF is a charity which is dedicated to
getting the best for other charities and their donors. We
provide financial services, advice and training to charities, as
well as processing donations to them, freeing them up to
concentrate on their charitable works.
2.2 Any donation which you make using the
website will be made to CAF itself. CAF is itself a
registered charity, so your donation may be eligible for Gift Aid
(see paragraph 3 for more details).
2.3 Although your donation will be made to
CAF itself, you can choose a charity from the list available on the
website to which you would like CAF to pass on your money. The trustees of CAF will usually pass on your donation to your
chosen charity in accordance with your wishes, although they retain
a final discretion over whether or not to do so.
2.4 CAF is not responsible for any
dissatisfaction you may have about how your chosen charity uses any
donation which you make through the website.
3 MAKING DONATIONS AND RECLAIMING GIFT AID
3.1 You can make donations by following the
instructions on the website. Donations can be made by debit
card, credit card or by transferring money through PayPal.
3.2 Once a donation is made using the
website, the transaction is final and cannot be disputed or
reversed unless it was made fraudulently. If you become aware
of any fraudulent use of your debit card, credit card or PayPal
account you should report this to your card operator or to PayPal
in accordance with their reporting rules.
3.3 When you make a donation using the
website and confirm that you are a UK taxpayer in accordance with
the requirements of the Gift Aid scheme from time to time, we will
reclaim Gift Aid on your donation under the Gift Aid
scheme and add this to your gift. Further details about this
will be given when you use the website to make a donation.
Please note that CAF is not a financial, tax or accounting adviser
and you should not rely on information on the website to determine
the financial, tax or accounting treatment of any donation which
you make using the website.
3.4 When you make a donation, it may be
necessary for us to verify your identity or the details which you
have given to us. You agree that you will provide such
information or documents as we may reasonably request from time to
time to enable us to do this.
3.5 If you do not have a CAF Charity Account
or CAF Charitable Trust then a fee of 4% will be deducted from the
sum of your donation and any Gift Aid reclaimed, to cover our
administrative costs. If you are a CAF Charity Account or CAF
Charitable Trust customer then the amount of the fee deducted will
be in accordance with the existing terms of your CAF Charity
Account or CAF Charitable Trust but unless you have logged in when you make your donation you will be charged the 4% fee and not those applicable under your existing terms.
4 CHANGES TO THE SERVICE
4.1 CAF will use reasonable endeavors to ensure
that the website and the ability to make donations through the
website is available continuously but retains the right to modify,
suspend or terminate the website and the ability to make donations
through the website from time to time without notice. Except
as otherwise specified, any new features, services or functionality
of the website which are introduced from time to time will be
subject to these terms of service.
5 NON-ADHERENCE TO THESE TERMS OF SERVICE
5.1 If you do not comply with these terms of
service, CAF has the right to temporarily suspend or permanently
revoke your ability to use the website to make donations.
6 YOUR PRIVACY
6.1 Your privacy is important to us.
Please read our privacy policy to see how we may use
your personal information.
7 GOVERNING LAW
7.1 These terms of service are governed by
English law and are subject to the exclusive jurisdiction of the
English courts.
